Droit moral in selected legal systems of Asia, by example of the right to authorship of a work : where are we coming from, and where are we going

    Get PDF
The specification of droit moral in Asian countries cannot be encapsulated uniformly in a clear-cut way, as the individual countries present certain dissimilarities in this respect. It is, however, possible to attempt to establish groups showing the general mechanisms governing the development of moral rights in this part of the world. A presentation of the copyright regulations of Asia gains importance if we concentrate on the currently progressing globalisation of intellectual property rights (Jena, 2005: p. 7; Swadźba, 2006: p. 33–39) and the convergence of the Asian countries’ economies (Freeman, 2003: p. 158–159). This analysis will be carried out based on the laws of countries such as: Thailand, Malaysia, Indonesia, Singapore, the Philippines, Vietnam, India, Taiwan, Hong Kong and Japan

In this paper, the author presents intellectual property law policies related to geodata. The sole purpose of this paper is to open up this problem for further investigation and discussion. The concepts of geodata and legal interoperability have not received as much scholarly attention as they merit. Drafting one single model for geodata access is especially hard, given that geodata is produced and maintained in multifold environments. This makes it important to confront and discuss the factors influencing the licensing of geodata. On this basis the author proposes a taxonomy of the extremely diverse licenses for geodata.W niniejszym artykule autorka przedstawia zasady prawa własności intelektualnej rządzące geodanymi.

The 2015 edition of OpenStreetMap US State of the Map conference took place in New York, from 6–8 June. The event was held at the United Nations Headquarters, a strong reminder of the international nature of the project, with this event attracting 834 participants from 41 countries. It is easy to appreciate the merit of the conference, just by taking a look at the variety of topics covered, the range of disciplines involved, and the many experts from diverse areas of science presenting there. It is impossible to address all the presentations made during the event, due to the sheer scale and the diversity of themes, so this report concentrates mostly on key topics rather than on the almost innumerable individual speakers

On the implications of the unalienability of the right of authorship for ghostwritting contracts

    Get PDF
This paper will argue that the right of authorship is unalienable even when it becomes subject to a commercial contract (of which some of examples are ghostwriting agreements such as those for political speeches and autobiographies). The paper will argue further that the general concept of moral rights is weakened by theories which allow ghostwriting in order to keep the theory of copyright law close to practice. Practice, however, is sometimes morally dubious. This paper’s purpose is to show that ghostwriting defies many rules as the scope of the term encompasses many

This article examines the question of giving the status of the entity to agents of artificial intelligence, who, technically equipped with the tools allowing them acquisition of rights and taking on liabilities, more and more often participate in trading, especially in online trading. In the light of the ongoing technological development and the increasing number of adjudications on the basis of facts involving the functioning of artificial intelligence systems, it seems reasonable to present the legal and philosophical conceptual framework for discussion on artificial intelligence

Library privileges constitute an example of public fair use, which enables libraries to function. It is to emphasize that the copyright law that assigns an author the proprietary and moral copyrights limits his monopoly by the institutions of the public and personal fair use. It is a result of the proportional right of use of the scientifi c and artistic production protected by the copyright. The notion of “library material” is much broader than the idea of a work of art but it does not change the fact that the vast part of the library collection is protected by the copyright law. The special character of the books, that constitute the intangible goods, can be specifi ed by the use of the copyright article 28, which clearly includes this kind of characteristic. At the same time, the regulation of the library privilege seem to bring to light new questions about its practical use and the adjustment to the need of the readers expecting digital forms of access to the library materials

The reason for writing this article was the generation (by an algorithm called “Quakebot” written in programming language by the “Los Angeles Times” journalist, Ken Schwencke) of a press release about the earthquake that was registered five miles from Westwood (California, USA) on 23 December 2013. This information was prepared on the basis of the USGS Earthquake Notification Service message posted on the government website. The article formulates the view that the personal nature of employment does not exclude the possibility of creating a work with the use of artificial intelligence. In addition, it was found that the piece of work does not lose its legal character even if it was created with the use of public sector information, as well as that it is acceptable to re-use public sector information for commercial purposes, obtained through Artificial Intelligence

    Get PDF
Since its beginning, the European Union has transformed, undergoing many stages of integration, from its origins as a free trade zone, to a customs union, on to a common market, then to an economic monetary union. The establishment of the euro zone was an economic plan aiming to increase the competitiveness of the European economy. At present this economic plan is being embraced by the Polish economy. In this context, the prospect of our country, joining the monetary union, from the perspective of Polish companies, is of particular importance. The main aim of this paper is to attempt to recognize whether Poland’s access to the euro zone is perceived as an opportunity or a threat by Polish managers. First, the authors, by quoting literature written on the subject will present the opportunities and threats related to the functioning of the economic monetary union, then illustrate how they pertain to Poland. This overview is accompanied by empirical research, which took a form of direct interviews conducted in 230 companies from all over Poland
